GALA has made some successful complaints recently. A number preceding an item is the number allocated to the complaint by the Advertising Standards Complaints Board.

Complaint 2001/114 has been won. This was for a newspaper advertisement for Waikato Draught beer which depicted the Chiefs rugby team. It breached Principle 4, Guideline 4(c) which prohibits the use of heroes of the young in liquor advertising.

 

COMPLAINT 01/05: GALA has won an appeal to the Advertising Standards Complaints Appeal Board about an alcohol advertisement shown on Prime TV. The Crown and Badger Restaurant advertisement was screened at 7.40 pm in November 2000. It opened with a scene outside the restaurant, where the word Guinness was illustrated several times on the soffit. It stated "The Crown and Badger, more than just a pub......"

GALA complained that this was an advertisement for a liquor outlet, screened before 9pm. The complaint was not upheld by the Advertising Standards Complaints Board, so GALA took it to the Appeal Board. 

The Appeal Board agreed with GALA's complaint that this was an advertisement for a liquor outlet. They commented on the importance of the decision for the diversity of outlets selling liquor now. They said that any advertisement for an outlet, which promoted liquor in any way for sale will need to comply with the code for liquor advertising. Examples are, they said , a bottle of wine in a supermarket trolley, or beer on supermarket shelves.

Note: it took 6 months for this decision to wend its way through the complaints procedure.


Complaint 99/134.   This complaint was about a newspaper advertisement for Waikato Draught beer. It showed a six-pack of the beer and carried a caption about Waikato being famous for a mobile pack. GALA complained that this referred to the Waikato provincial rugby team and that the advertisement thus breached the "heroes of the young" rule. 

Complaint 99/109.   This complaint resulted from receiving junk mail advertising from a liquor outlet. The advertising included a picture of a carton of Waikato Draught beer on which members of the Chiefs rugby team were shown. 

Nothing on liquor packages comes within the jurisdiction of the ASCB as it has been ruled that packaging is not advertising. 

However a picture of a package in an advertisement is a different matter and a complaint under the "heroes" rule was upheld.

Complaint 99/56.   Junk mail advertising for the Eastside Bar in Hamilton contained reference to the All Blacks. Again a complaint was made under the "heroes" rule. This complaint did not go before the ASCB. The advertiser admitted the error and the Chairman of ASCB ruled the complaint "Settled"

Broadcasting Standards Authority

Complaints were made to TVNZ about four separate programmes of Superliquor Sportsnight on the grounds that the sponsor's name was seen or heard more frequently than the rules permit.

TVNZ upheld the complaint but GALA then referred the complaints to the Authority hoping that a penalty would be imposed on TVNZ.

The authority fined TVNZ $500 for each of the four offences.
